GLOBAL TERMS – ALL STEVE WHITE MORTGAGES APPS & SERVICES

SUMMARY OF SERVICES

Steve White Mortgages is a licensed mortgage agent working under the sponsoring brokerage Pineapple License 12830 and arranges mortgage financing for clients located within Ontario. The Steve White Mortgages Sports Support Program provides donations to minor sports leagues and teams in our service area. Fundraisers, or Team Members (parents, team organizers or other supporters), are able to access donations by using Steve White Mortgages and Pineapple brokerage for mortgage services such as (but not limited to): home purchases, refinances, switches, lines of credit, etc. Team members are able to access a customized webpage with tracking information to ensure donations are directed to the proper supporting team. When a Team member takes action with that form and uses Steve White Mortgages to secure a mortgage through a third party bank or mortgage lender, a donation will be paid to the team. The donation amount will vary depending on the mortgage type and lender. Donations will be generated from various programs offered by the lender including, but not limited to, broker commissions.

Team Members are under no obligation at any time to complete a transaction with Steve White Mortgages or Pineapple brokerage. As an independent mortgage advisor, Steve White Mortgages will be required to generate a full mortgage application and submit to lenders for approval. Steve White Mortgages will work in the best interests of the Client (Team Member) and provide the best mortgage option available. Should the Team Member choose not to accept the mortgage offered, the application will be considered cancelled and no fees will be paid by the Team Member and no donations will be made to the Team.

PRIVACY

These Terms of Use incorporate by reference our Privacy Policy, available at stevewhitemortgages.ca/privacy that governs the collection and use of all personal information of Users. Except where specifically indicated, we do not knowingly collect any personal information of persons under 18 years of age. You have the right to know the personal information collected, used, disclosed for a business purpose, and sold about you during the preceding 12 months, including the categories of sources from which we acquired your information and the categories of third parties to whom we disclosed your information for a business purpose or sold your information. Further, you have the right to opt-out of sharing any such information or request that the Company delete any personal information we have collected from you or maintain about you. If you request that we delete your personal information, we will do so except to the extent we determine that we need the information for a business purpose and have a legal right to maintain it, in which case we will inform you of that legal exception. Please email Steve@SteveWhiteMortgages.ca in order to exercise any of the rights listed above.

In addition to information collected by our website through the use of cookies, we provide several online forms and mortgage applications for Team Members and Clients to complete. This additional information is provided willingly and as needed to complete mortgage applications. The storage and use of this information is bound by the Financial Services Regulatory Authority of Ontario – www.fsrao.ca.

AVAILABILITY OF SERVICES

The Services are offered to Users subject to acceptance of all of the terms and conditions contained in these Terms of Use and any additional terms applicable to certain uses of the Services, such as the terms applicable to Lenders. Specific additional mortgage terms and conditions are disclosed at the time of reviewing a mortgage approval.

MODIFICATION OF SERVICES

Steve White Mortgages reserves the right to modify or discontinue the Services (or any part thereof) at any time with or without notice. In addition to and without limiting the disclaimers in these Terms of Use below, we make no representation or warranty that particular Content will be available (or will continue to be available) at any particular time, or that Team Members will be able to access the Program, and we are under no obligation to undergo any update of the Program to the extent any material, Content or features contained therein or related thereto is out of date.

TRANSMISSION OF INFORMATION

Because we do not control the security of the Internet or other networks you use to access the Steve White Mortgages website or communicate with us, we, Pineapple and other Users cannot be, and are not responsible for, the security or loss of information that you choose to communicate with us while it is being transmitted. 

OBLIGATIONS OF FUNDRAISERS AND TEAMS

Teams are subject to approval by Steve White Mortgages at our sole discretion. Teams and their payment recipients will be considered and approved in accordance with our Teams Guidelines. We reserve the right to contact any third party listed as a recipient of the raised funds to request information that will enable us to approve and to verify the validity of the Team, and such proposed recipient of funds may decline the funds raised or proposed to be raised, and at any time thereafter, any proposed or present payment recipient of any campaign may opt-out of the receipt of future funds at any time by emailing us at steve@stevewhitemortgages.ca.

WEBSITES OF OTHERS

We provide news, advice and articles that may contain links to websites maintained by other parties. These links are provided solely as a convenience and not because we endorse or have an opinion about the contents of such websites. Steve White Mortgages expressly disclaims any representations regarding the content or accuracy of materials on such websites or the privacy practices of those websites. If you decide to access websites by other parties, you do so at your own risk and in accordance with their respective terms of use and privacy policies.

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, THE SERVICE, THE CONTENT, AND SUBMISSIONS ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS AND STEVE WHITE MORTGAGES, PINEAPPLE, PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. (B) THIRD PARTY COMMUNICATIONS,
(C) ANY THIRD PARTY WEBSITES OR CONTENT THEREIN DIRECTLY OR INDIRECTLY ACCESSED THROUGH LINKS ON THE STEVE WHITE MORTGAGES WEBSITE PLATFORM, INCLUDING BUT NOT LIMITED TO ANY ERRORS IN OR OMISSIONS THEREFROM,

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, STEVE WHITE MORTGAGES AND ITS SUPPLIERS (INCLUDING LENDERS, BROKERAGE, PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS) SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE STEVE WHITE MORTGAGES WEBSITE, THE SERVICE, THE CONTENT, THE SUBMISSIONS, ANY FACTS OR OPINIONS APPEARING ON OR THROUGH THE STEVE WHITE MORTGAGES WEBSITE, OR ANY THIRD-PARTY COMMUNICATIONS. TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, STEVE WHITE MORTGAGES AND ITS SUPPLIERS (INCLUDING LENDERS, BROKERAGE, PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS) SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE STEVE WHITE MORTGAGES WEBSITE, THE SERVICE, THE CONTENT, THE SUBMISSIONS, OR ANY THIRD-PARTY COMMUNICATIONS. TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, TO THE EXTENT THE FOREGOING LIMITATION OF LIABILITY IS PROHIBITED OR FAILS OF ITS ESSENTIAL PURPOSE, STEVE WHITE MORTGAGES’ AND ITS SUPPLIERS’ (INCLUDING LENDERS, BROKERAGE AND PAYMENT PROCESSORS) SOLE OBLIGATION TO YOU FOR DAMAGES SHALL BE LIMITED TO $100.00 IN THE AGGREGATE. FOR GREATER CERTAINTY, THE EXISTENCE OF ONE OR MORE CLAIMS UNDER THESE TERMS OF USE WILL NOT INCREASE THIS MAXIMUM LIABILITY AMOUNT.

INDEMNIFICATION/RELEASE

You agree to defend, indemnify and hold harmless Steve White Mortgages, its parents, subsidiaries, affiliates and their respective present and future directors, officers, licensors, suppliers and vendors, third-party information providers, employees, agents, successors and assigns from and against all claims, losses, expenses, damages, and costs, including legal fees, arising out of or related to any violation of these Terms of Use by you, any Submissions uploaded or submitted by you and/or any false, infringing or misleading information that you submit to the Steve White Mortgages Website, any services purchased by you in connection with the Services. You are solely responsible for your interactions with other Users of the Services. Unless prohibited by applicable law, you assume all liability for any claims, suits or grievances filed against you, including, but not limited to, all damages related to your participation in any of the Steve White Mortgages Website. To the extent permitted under applicable laws, you hereby release Steve White Mortgages from any and all claims or liability related to any product or service of a Lender, any action or inaction by Lender, including Lender’s failure to comply with applicable law and/or failure to abide by the terms of a Voucher, and any conduct or speech, whether online or offline, of any other User.

CANCELLATION

If you want to close your account, please notify us in writing by sending an email to our Customer Support Center at steve@stevewhitemortgages.ca. While we are ready to assist you in managing your subscriptions, closing your account, and removing your active profile, we cannot always delete records of past interactions and transactions. For example, we are required to retain records relating to previous purchases on the Sites for financial reporting and compliance reasons.

We will retain your information for as long as your account is active or as needed to provide you services and to maintain a record of your transactions for financial reporting purposes. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at steve@stevewhitemortgages.ca. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

GOVERNING LAW

Unless otherwise required by applicable mandatory local law, these Terms of Use are governed in accordance with the internal law of the Province of Ontario, Canada without reference to its principles of conflicts of laws, and any action arising out of or relating to these Terms of Use shall be filed only in the courts located in Toronto, Ontario. You hereby consent and submit to the exclusive personal jurisdiction of the applicable courts set forth above for the purpose of litigating any such action.

WAIVER AND SEVERABILITY OF TERMS

The failure of Steve White Mortgages to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the other provisions shall remain in full force and effect. A waiver of any provision of this Agreement shall only be valid if provided in writing and shall only be applicable to the specific incident and occurrence so waived.

STEVE WHITE MORTGAGES FUNDRAISING SERVICE TERMS

EARNED DONATIONS 


(i) Donations earned through the use of the Service to support a Team represents the exact amount that will be received by the Team (“Donations”). The determination of whether a transaction qualifies for a Donation is at the sole discretion of Steve White Mortgages.
(ii) The sum of all Donations will be provided in quarterly statements, providing the outstanding balance is greater that $1. Donations will be recorded after all associated commissions, benefits and fees have been received by Steve White Mortgages.
(iii) At our sole discretion, we may, without notice, deduct Donations from your Team to make adjustments for returns and cancellations of Services. Any such adjustments will be made in accordance with this Agreement, any applicable Steve White Mortgages policies and terms, the terms of the Lender offer and any and all applicable laws, rules and regulations. In addition, Steve White Mortgages may make account adjustments for any Donations that Steve White Mortgages, in its sole discretion, deems as fraudulent, abusive, unethical, suspicious or otherwise inconsistent with this Agreement or any other applicable law or regulation. Steve White Mortgages decisions are final. Should you disagree with any adjustments made to your account or payments made to you, your sole remedy is to withdraw from the Service.
(iv) It is your responsibility to check your Team regularly to ensure that Donations have been properly credited and that your Team balance is accurate. If you believe that Donations have not been correctly credited to your Team, you must contact us to review.

PAYMENT TO TEAMS

Donations are paid quarterly to Teams by check, e-transfer and sent to the Payment Recipient selected by Fundraiser during account creation.

CLIENTS

If you choose to support a Team by engaging in our Services, you become a Client and are subject to the following obligations in addition to all other terms and conditions in these Terms of Use:

(i) You willingly engage Steve White Mortgage services for the purpose of obtaining real estate and mortgage advice and to act as a broker to arrange mortgage financing

(ii) You are under no obligation to complete transactions or accept mortgage approvals provided.

(iii) Donations will be made to the Team for full mortgage applications received and additional Donations made upon mortgages closing and Steve White Mortgages receiving funds from the Brokerage and Lender in the form of commissions, benefits and fees.

(iv) Subsequent mortgage Services will also receive Donations to the Team, as long as the Service is provided by Steve White Mortgages.

REFERRING FRIENDS TO STEVE WHITE MORTGAGES

Your Team may be eligible to receive Donations for referring friends. If you wish to refer friends to Steve White Mortgages, you must provide them with a link your Team Page within Steve White Mortgages, which you can share directly with others via email, social media websites, or other communications methods. If someone submits an inquiry from your Team Page form and then completes a formal mortgage application, a Donation will be credited to your team. When that person closes on a mortgage with Steve White Mortgages, an additional Donation calculated on the mortgage amount will also be credited to your Team for the next quarterly payout.

SPONSORSHIPS AND OTHER GIFTS

Steve White Mortgages periodically runs team sponsorships and provides gifts to players and their families. Gifts can include, but aren’t limited to, monetary benefits, equipment, gift cards, or access to entertainment events. All sponsorships and gifts are based on Team Fundraising success and are subject to review and may terminate without prior notice.

ACCOUNT LIMITS & FEES

(I) There are no fees due to take part in the Service

(ii) There are no processing fees for accepting payments by cheque or e-transfer

(iii) There is a minimum Donation payout amount of $50. If your Team has not generated Donations above that amount, those funds will be carried over to the next quarter.
